JOHANNESBURG, (CAJ News) – SKYWISE Airline has registered a case against the Airports Company of South Africa (ACSA) with the Competition Commission.

This is in addition to the court case against ACSA over a pay dispute.

The low-coast airline argued ACSA’s conduct towards grounding Skywise was an “abuse of dominance” and “a prohibited practice.”

“It is prohibited for a dominant firm to refuse to give access to an essential facility when it is economically feasible to do so,” said Tabassum Qadir, Skywise Co-Chair.

The company appealed to the Competition Tribunal to investigate.

The officials asked how it was economically feasible for ACSA to suspend Skywise Airlines in the month of December for an arrear instalment of R1,6 million, while they had R1,9 million in deposit and Skywise was on fly-as-you -pay arrangement.

Skywise Airlines had projected revenue of more than R50 million in December which was lost.

“It was a deliberate attempt and very soon we will reveal this,” said Malik.

Comment could not be obtained from ACSA.
